Justice

Injustice faced by injured workers include:

  • Stigmatization and suspicion from employers, co-workers, the workers’ compensation system and the general public

  • WCB decision makers denying otherwise legitimate benefits and services to meet performance measure targets and to reduce expenses

  • Obtaining medical/legal opinions from in-house medical advisers and consultants, and outside specialists to contradict the opinions of treating physicians, surgeons and other specialists.

  • Sharing confidential medical information with employers without consent and contrary to the legislation

  • Case management practices focused on prematurely reducing benefits, such as providing inappropriate initial and ongoing medical treatment, developing programs focused on quick rather than safe return to work, deeming workers capable of working in jobs they don’t have or don’t exist, etc.
